On-Line Trade in Program Terms & Conditions

 

ONLINE TRADE-IN PROGRAM TERMS & CONDITIONS AGREEMENT

Please stop and take a few minutes to read this agreement carefully.

Binding Agreement: By participating in Refurb Rebels’s Trade-In Program offered on the www.refurbrebel.com website (which will be referred to as the Online Trade-In Program in this agreement), YOU AGREE TO BE BOUND BY THESE TERMS & CONDITIONS (EXPLAINED BELOW) AND THE REFURBREBEL.COM CONDITIONS OF USE. It is your responsibility, prior to participating in this Online Trade-In Program, to read these Terms & Conditions carefully to understand your rights and obligations. If you are dissatisfied with Refurb Rebel, its content, or these Terms & Conditions, you agree that your sole and exclusive remedy is to not participate in the Online Trade-In Program.

Changes: Refurb Rebel reserves the right to make changes to these Terms & Conditions at any time. Each time you wish to participate in the Online Trade-In Program, you should review the then-current Terms & Conditions. Refurb Rebel may terminate the Online Trade-In Program at any time, without notice to you.

Rights and Obligations Regarding the Online Trade-In Program: You agree to the following terms and conditions:

  1. Ownership and Authority to Trade-In. You represent and warrant that you are the sole and rightful owner of the item bearing the specifications, serial number, and model number which you have offered for trade-in (the "Item") and have full authority to sell or otherwise dispose of the Item. You further represent and warrant that (1) You are an Australian Citizen over the age of 18 and you have the power and authority to enter into this agreement; (2) the Item(s) is (are) not counterfeit or stolen; and (3) the Item(s) does (do) not violate any law in Australia .
  2. Deactivate. You agree to deactivate all services to your Item(s) and remove any and all codes (including without limitation removing user locks, passwords, and/or turn off/deactivating the “Find My Device” feature) that may prevent Refurb Rebel from having the ability to use, refurbish, recycle, resell or dispose of the Item.
  3. Accuracy of Information. You agree that all information you provide about the Item for trade-in, as well as information you have or will provide about yourself, is true, accurate, and complete.
  4. Limitations and Final Determinations. You acknowledge and agree that Refurb Rebel may, in its sole discretion, reject any Item/s to be traded in under the Online Trade-In Program. If Refurb Rebel rejects an Item(s) you you will have the Item returned to you, You agree that all determinations of Refurb Rebel with respect to trade-in and value assigned to the Item after its inspection are made in Refurb Rebels’s sole discretion, will be accepted as final, and are not negotiable.
  5. Working Condition Upon Arrival. You agree that you are providing the Item to Refurb Rebel in working condition, and you shall be solely responsible for the arrival condition of the Item at Refurb Rebel's facilities. It is important that you carefully package the Item to ensure that the Item is delivered to Refurb Rebel without damage as those damages are your responsibility.
  6. Prompt Shipment and Promotional Offers. You agree to ship the Item to the address provided so that it arrives within 14 days of accepting the estimate. If the Item is not received within 14 days of the date on which the estimate was provided to you, then Refurb Rebel has the right to revise or withdraw the estimate for the trade-in or value of the Item. 
  7. Costs of Packaging and Shipment. Refurb Rebel will provide you with an Australia Post prepaid shipping label for the shipment of your Item to Refurb Rebel . You agree that you are solely responsible for all costs associated with the packaging of the Item for shipment to Refurb Rebel.
  8. Loss or Damage to the Item and Its Contents. You agree that Refurb Rebel, will not be responsible under any circumstances for any loss or damage to the Item. In addition, you acknowledge that it is your sole responsibility to remove all personal data (e.g., files, photos, videos, music, etc.) from the Item (e.g., PCs, laptops, wireless phones, iPod's, MP3 players, etc.). You agree that Refurb Rebel, is not responsible for the loss or destruction of the hardware, software, files, or media containing any personal data left on or in the Item. You understand and agree that you will not be able to recover any data or files stored within the Item.
  9. Transfer of Ownership. Upon receipt and acceptance of the Item by Refurb Rebel, you hereby agree to transfer all right to and title in the Item to Refurb Rebel, in exchange for the trade-in value quoted to you.
  10. Items Inconsistent with Provided Description. If Refurb Rebel provides notification that your description of the Item was inconsistent with Refurb Rebel,s evaluation of your Item, you will be provided with an updated quote of trade-in value. You may elect to either trade your Item in exchange for the updated trade-in value, or you may elect for the Item to be returned to via Australia Post at Refurb Rebels Expence  
  11. Final Transaction. No Rescission. You acknowledge and agree that the trade-in transaction is final and cannot be cancelled or rescinded by you after your Item is received by Refurb Rebel, unless Refurb Rebel contacts you to provide notification that your description of the Item was inconsistent with Refurb Rebel’s evaluation of your Item.
  12. Release of Liability. To the extent permitted by applicable law, you hereby release Refurb Rebel, from and against any liability arising out of or related to the transfer of the Item, including but not limited to any liability related to the shipment of the Item, the deletion or non-deletion of any data or files from the Item, the evaluation and assessment of the Item (and the corresponding trade-in valuation) made by Refurb Rebel, and the non-availability of the Item after it has been accepted by Refurb rebel.
